This Privacy Policy does not cover any information that you make publicly available through the Service or your use of any of apibit’s paid products, nor does it cover apibit’s employees, former employees or job applicants and prospects.

apibit.com offers a public website where you can search for and share information about technology products, services and providers, communicate with Site users, contribute reviews of technology products and services, and connect with software providers.

How We Share Your Information with Others

apibit may share your information with providers of products and services listed on the Site, our business partners, our service providers, social media networks, our affiliates, and any other third parties whom you authorize us to share your information with.

apibit may receive monetary or other valuable consideration for sharing your personal information when you submit a request to be contacted by a provider on the Site, or when you leave a review on the Site that we share with our clients. We do not share personal information with any other third parties. The personal information that is shared includes your first and last name, and email. Any other information you submit with your request or review will also be shared. apibit also, in limited circumstances, shares personal information with cross-context advertising partners.

Where apibit sells or shares your personal information, we do so to promote our products and services across platforms; to allow our clients to display your reviews on their sites; and to provide clients with meaningful insight into their competitive landscape.

apibit has not sold any other personal information for any other purpose in the last 12 months. apibit does not sell sensitive personal information, and the sensitive personal information that we collect is limited to your account login information and password.

3. Cookies, Analytics, and Other Tracking Technologies

Cookies and Tracking Technology

We want you to be aware that certain online tools exist to help us serve and recognize you when you visit the Site. We receive and store certain types of information when you visit the Site. When you access the Site, we (including companies we work with) may place small data files on your computer or other device. Do Not Track Signals

4. Reviews and Other Content Published on the Site

If you leave a review on the Site, or participate on a discussion board, your review(s) or comments will be publicly available on and off of the Site. Other users may be able to identify you, or associate you with your account, if you include personal information in the content you post publicly. You can reduce the risk of being personally identified by using the Service anonymously. Please also note that the messages you send or receive using the Service are only private to the extent that both you and the recipient(s) of your messages keep them private. For example, if you send a message to another user, that user may choose to publicly post it. We may access, review, and disclose such messages in connection with investigations related to use of the Service, as well as our efforts to improve the Service.

Submitting reviews and comments is entirely voluntary. By submitting reviews and comments, you grant apibit an authorization to publicly share them and sub-license the content according to our Terms of Use. This means that we can authorize the providers of software products and services to share this content through their websites, social media sites, or other marketing materials, such as slide decks or case studies, and/or the operators of other publicly-available websites, social media sites, platforms, or mobile apps to republish this content.

If you posted an attributed review under your name, you can change your mind later, and we will anonymize or delete it. However, please understand that we cannot guarantee others did not store the personal information prior to the change, by printing or downloading the original post.

You may also designate an authorized agent to act on your behalf.

Please note that apibit may retain a record of your request to delete your personal information.

You have the right to opt out of the sale or sharing of your personal information, including for the purpose of cross-context behavioral advertising. To opt out of cross-context behavioral advertising, please activate the “Do Not Sell” option in your cookie preferences. To opt out of other kinds of sale or sharing, please visit our opt-out form.

As of July 2023, apibit does not sell, share, or otherwise make available for commercial purposes the personal data of 10 million or more California consumers.

apibit also responds to enabled Global Privacy Control (“GPC”) browser settings. By enabling the GPC in a supported browser, your activity on that browser will be automatically opted out of the sale and sharing of your personal information through cookies.

Notice of Financial Incentive: apibit may offer you a gift card in exchange for a review (an “incentivized review”). We collect the same categories of personal information disclosed in Section 2 for incentivized and unincentivized reviews, and your personal information is subject to this Privacy Policy in the same way. Completing an incentivized review is optional.

Please note that reviews must meet our Community Guidelines to qualify for a financial incentive.

Shine The Light. If you are a California resident, this section applies to you. The California Shine the Light law (Cal. Civ. 6. Processing in the United States

If you are accessing the Site from outside the United States, please be aware that your personal information will be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. The data protection laws of the United States may not be equivalent or as comprehensive as the data protection laws as those in your country.

Your personal information may be processed outside your jurisdiction, including in countries and jurisdictions that are not subject to an adequacy decision by the European Commission or your local legislature or regulator, and that may not provide for the same level of data protection as your jurisdiction. 7. Data Privacy Framework

apibit complies with the EU-U.S. Data Privacy Framework program (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework program (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. apibit has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. apibit has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework program Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. In compliance with the EU-US Data Privacy Framework Principles, apibit commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to the DPF Principles. European Union, Swiss and United Kingdom individuals with DPF inquiries or complaints should first contact apibit at privacy [at] apibit.com.

apibit has further committed to refer unresolved privacy complaints under the DPF Principles to an independent dispute resolution mechanism, Data Privacy Framework Services, operated by BBB National Programs. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit the BBB website for more information and to file a complaint. This service is provided free of charge to you.

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms.

8. Security

We have implemented appropriate administrative, technical, and physical security procedures to help protect your personal information.

For example, only authorized employees are permitted to access personal information that you have not published on the Site, and they only may do so for permitted business functions. Our security and privacy policies are periodically reviewed and enhanced as necessary, and only authorized personnel have access to personal information that you have not published on the Site. In addition, we use encryption when transmitting your personal information between your system and ours, and we, together with our partners, employ firewalls and intrusion detection systems to help prevent unauthorized persons from gaining access to your non-public information.

9. This Site is Not Intended for Children

The Site is a general audience site and does not offer services directed to individuals under 18 years of age.

apibit retains your personal information for as long as necessary to provide our services or during the period in which we have an ongoing legitimate business interest, to prevent, investigate, or identify possible wrongdoing in connection with the Site or to comply with legal obligations. With respect to personal information that has been collected using cookies and similar tracing technologies, you can view retention periods in our Cookie Policy, as well as adjust and/or disable certain tracking. Information that you submit through your user profile is retained for the lifetime of your account with us. Please note that software product and service providers listed on the Site cannot remove their profile page, ratings, or reviews by closing their accounts.
